Are you an Australian employer looking to secure top-tier global talent, or a skilled professional ready to take the next step in your career?

The Subclass 482 (Skills in Demand / Temporary Skill Shortage) visa is Australia’s flagship employer-sponsored visa, enabling approved businesses to sponsor overseas workers to fill genuine skill shortages.

The 3-Stage 482 Visa Process

Navigating employer-sponsored migration requires precise compliance with Australian migration law. The process involves three distinct, sequential stages:

Stage 1

Standard Business Sponsorship (SBS)

Stage 2

Position Nomination

Stage 3

Visa Application

Stage 1: Standard Business Sponsorship (SBS)

Before hiring from abroad, the employing business must be approved as a Standard Business Sponsor by the Department of Home Affairs:

  • The business must be legally established and actively operating.
  • The business demonstrates a commitment to employing local labour and complying with Australian workplace and immigration laws.
  • Validity: once approved, sponsorship is typically valid for 5 years.

Stage 2: Position Nomination

The employer identifies the role and nominates the candidate for the specific vacancy:

  • Eligible skilled occupation: the role must correspond to an eligible occupation on the relevant skilled occupation list.
  • Genuine position: evidence that the business genuinely requires the role within its scope and organisational structure.
  • Market salary benchmarking: the salary offered must meet or exceed both the Annual Market Salary Rate (AMSR) for equivalent Australian workers and the Core Skills Income Threshold (CSIT).
  • Labour Market Testing (LMT): the employer must demonstrate that they have tested the local Australian labour market, unless exempt under International Trade Obligations or specific treaty rules.

Stage 3: The Visa Application

The candidate applies for the visa, proving they meet the statutory requirements for the nominated occupation:

  • Relevant work experience: generally at least 1 to 2 years of relevant, post-qualification work experience in the nominated occupation or a closely related field.
  • Skills and qualifications: relevant tertiary or trade qualifications matching the ANZSCO skill level.
  • English proficiency: meeting specified scores in approved English tests, unless holding an exempt passport or qualifying for salary or education exemptions.
  • Health and character: satisfying mandatory Australian health and character checks.

Special Focus: The Dedicated Hong Kong Pathway to PR

Holders of a Hong Kong Special Administrative Region (HKSAR) or British National (Overseas) (BNO) passport enjoy unparalleled legislative concessions under Australian migration law.

1. Automatic 5-Year Subclass 482 Visa Grant

Under Schedule 2 of the Migration Regulations 1994, Subclass 482 visas granted to eligible Hong Kong passport holders are issued with an automatic 5-year validity period, giving candidates and employers long-term operational certainty from day one.

2. Direct, Streamlined Permanent Residency (Subclass 189 & 191)

Unlike standard visa holders who must wait for employer agreement under the Temporary Residence Transition (TRT) stream or face points test cutoffs, Hong Kong passport holders have a dedicated, independent PR pathway:

  • Subclass 189 (Hong Kong Stream): transition to full Australian permanent residency after holding an eligible visa (such as the 482) and residing in Australia for 4 continuous years. No points test, no skills assessment, and no mandatory employer sign-off at the PR stage.
  • Subclass 191 (Hong Kong Regional Stream): transition to permanent residency after just 3 continuous years of living, working, or studying in a Designated Regional Area (such as Adelaide, Perth, Gold Coast, Newcastle, Geelong, or Ballarat).
